Gov. Kelly Ayotte this week signed into law an increased penalty for refusing a Breathalyzer test. At 68 percent, New Hampshire has the nation’s second-highest refusal rate because refusal currently results in a lower penalty than failing the test. The penalty for refusing a Breathalyzer test now rises from six to nine months. Ayotte described the former statute as a “DWI loophole” and stated it was a public safety priority. Opponents to the increased penalty say the Breathalyzer can often tag non-liquor substances like asthma inhalants and mouthwash.
