CONWAY — A key moment at last Tuesday’s marathon Kearsarge Lighting Precinct hearing on short-term rentals at John H. Fuller Elementary School in North Conway was the legal opinion issued by the precinct’s counsel on the precinct’s need to have a planning board in order to legally issue conditional-use permits for such rentals.
Kearsarge Lighting has a board of commissioners, a zoning board of adjustment and a master plan, requirements to issue those permits, but it does not have a planning board — required by state law to issue conditional-use permits as outlined in a petitioned warrant article submitted by Realtor Josh Brustin and others.
