Thank you so much for the Sun's editorial in which it said, “no amount of money can offset the loss of character that neighborhoods suffer when disrupted by constant flow of transient vacationers." Believe me, Kearsarge has and is suffering! This is why at every voting opportunity, residents of Kearsarge made it clear with an overwhelming no vote to non-owner occupied STRs.
I guess STR supporters will not take NO for an answer so long as the anti STR supporters continue to present an argument that is patently false, such as their mistatement that all STRs are a commercial use of the property. But wait... the State of New Hampshire teaches, as part of its Continuing Education Requirements for all licensed real estate salespeople, that the rental of a Single Family Dwelling is RESIDENTIAL...NOT commercial. QUOTE: "...a single family home that's rented out is still residential, even if realized income is the investor's intent in renting it." So the entire premise for banning STRs is false. The State of NH even teaches that it is false. And that is the main reason STR supporters will not take NO for an answer. It's that simple.
So many mistakes and misinformation, I barely know where to start. Let’s begin with “Believe me, Kearsarge has and is suffering!” Really? “Suffering”? I think that’s a good example of hyperbole. Next, the part of “no” that STR owners don’t except is the mistaken suggestion that a STR is a commercial use. It’s not. It’s every bit as much a residential use as if the owner was staying at the property. Also, the right to rent is a common law right. Lastly, the statement “No authority in this land will allow commercial enterprises in a residential neighborhood” is patently false. Just look to the accessory use notes in the zoning ordinance. But that doesn’t really matter because the use is residential. I hope that answers the question of why STR owners don’t accept your notion of NO when it comes to private property rights and your mistaken interpretation of zoning use regulations.
