OSSIPEE — During a pretrial hearing, a prosecutor and defense attorney battled each other in front of a Carroll County Superior Court judge Wednesday about whether Walmart surveillance videos showed a visually impaired man stealing items from the store on numerous occasions or if the man simply made a whole lot of mistakes at a self-checkout kiosk.

Now the judge is tasked with deciding whether to admit the surveillance video into evidence in an appeal trial for the man’s two theft convictions in a lower court.

I feel bad that this person has this disease and at such a young age. I could understand that this would be blown out of proportion if he was being charged with stealing one or two items that he may have missed scanning especially considering his condition. But when you miss 35 our of 37 you have to know that you did it on purpose.
