I am the president of Peak Resorts and was personally involved in negotiations for the purchase of the Wildcat Mountain Ski Area which closed on Friday, Nov. 19. A statement printed in The Conway Daily Sun stated “Graham puts the onus on Franchi for what happened to the long-term pass holders.” That statement was incorrect. The purchase and sale agreement, in fact, contained a list of existing lifetime pass holders and the seller, Wildcat Ski Reserve requested that the purchaser WC Acquisitions, Inc. honor the passes. The United States Forest Service, which issued the operating permit to Wildcat Mountain will not recognize lifetime passes. Both parties to the transaction discussed the issue in detail and attempted to negotiate an accommodation. Ultimately, the parties could not reach agreement on the matter and only then did the parties contract for the sale without such a provision.
