CONWAY — Construction has begun on the long-proposed cell tower off Artist Falls Road, even as the New Hampshire Supreme Court is about to consider a resident’s appeal of a $50 million lawsuit against the Conway Zoning Board of Adjustment over its approval of the project.

The nascent tower is estimated at about 160 feet. In 2021, the ZBA approved an application by Bear Hill Development of Natick, Mass., to build a wireless communications facility on a 36 acre parcel on the far northeastern edge  Artist Falls Road. The tower has been held up for years mostly due to litigation by Artist Falls Road resident Kevin MacMillan who lives on the other side of the road
