CONWAY — Artist Falls Road resident Kevin MacMillan has asked the New Hampshire Supreme Court to overturn a lower court dismissal of his lawsuit challenging Conway’s approval of a cell tower, alleging widespread due process violations, conflicts of interest and failure by town officials to consider health and zoning impacts — even as construction on the tower has begun.

In an appeal, MacMillan argued that the town improperly issued a building permit for a 160-foot wireless communications tower approved by the Conway Zoning Board of Adjustment in 2021 and that subsequent court proceedings denied him constitutional protections guaranteed under the Fifth and Fourteenth amendments.
