As Tri-County Community Action Program, Inc.'s Court Appointed Special Trustee, I write to clarify a few points made in Barbara Tetreault's article of June 26, 2013 concerning the end date of my special trusteeship and to recap what I have recently reported to, and requested from, the Court.
While I did recommend that some of my duties end on September 15th, my most recent report specifically requested that other duties and powers continue beyond September 15th for (i) purposes of ongoing monitoring and, more importantly, (ii) for the purposes of satisfying any legislative mandates. Subject to the Court's approval, I envision my withdrawal to be sequential, with the first change in my duties beginning on September 15th, but with ongoing involvement afterwards for an undetermined period of time. Because my departure must go as expected, I will remain ready and able to make any needed adjustments to ensure a smooth and successful transition. A critical piece of my proposed transition plan is my request to have ongoing and "specific authority" to (as I requested from the Court) "[e]nsure that [any legislative mandates] are completely satisfied so as to honor legislative intent." This is a very important point. Just days after I submitted this report, the legislature agreed to provide financial support to Tri-County CAP provided that I undertake certain actions to safeguard, and to report on, the expenditure of State funds. In anticipation of such legislation, I included this important language which will permit me to be accountable for Tri-County CAP's proper use of these funds and specifically empowered to ensure that funds are spent and used as intended. I gave my word to our legislators that I would be accountable, and I will be, even after September 15th.
