As part of the “ICEBREAKERS,” a legal team of retired attorneys formed by the North Country Immigrant Rights Coalition, I participated in authoring a similar letter to this one, sent out to Gorham, Berlin, and many New Hampshire communities. Our legal conclusions have since been verified by the NH ACLU and several noted New Hampshire attorneys. I stand by it.
Gorham Police Chief Jimmy Willhoite, in his memo on the department’s 287(g) agreement with ICE, cites purported protections for participating Gorham officers under the Federal Tort Claims Act, but there is, in fact, no protection for local officers under the Act, just for federal employees, and the Memorandum of Agreement (MOA) simply makes their treatment as federal employees for such purposes discretionary. Whether the Feds can deem local officers “federal employees” with the wave of their hand for the purposes of shielding them from liability is highly suspect.
