Former Berlin resident Felicia Hawkins, still sitting in a North Carolina jail awaiting trial on a charge of first degree murder, is doing very well, according to her attorney, Mike Klinkosum. Hawkins is accused of killing a Mount Airy man in June of last year and has been incarcerated in a county jail since then waiting for a chance to prove her innocence. Klinkosum said Hawkins passed a privately administered polygraph in November of last year, and since then, he has been in a discovery tussle with the district attorney. There are more than 5,000 pages of discovery materials and interviews regarding Hawkins case and under North Carolina laws, Klinkosum said it is pretty much left to the discretion of the district attorneys office as to what materials he will turn over. Problem is, he said, is that the district attorney's office seems unwilling to make the documents available even though Klinkosum offered to pay for copying them. The DA's office is required by law to turn over material that's exculpatory, but the rest of the material data can be held until trial.
Klinkosum has filed a motion to allow his office to copy the discovery documents and that motion is scheduled to be heard on March 11, in Surry County Court. A recently discovered 911 tape may prove to be beneficial for Hawkins and Klinkosum plans to concentrate his efforts on getting as much discovery material as he can before trial. Although Hawkins is still confined to a jail cell, Klinkosum said she is a strong girl and she is holding up well in spite of her surroundings. He hopes to know more after the motion is heard in March so he can plan a strategy for her defense and hopefully get her released on bail until the trial. Hawkins is confident she will be acquitted, but she's just trying to keep her spirits up until a trial date is scheduled.
