The town was right in taxing FairPoint phone company for use of "air space" for wires over the road, Carroll County Superior Court recently ruled.

The ruling harkens back to a Supreme Court determination in 1999 that telecommunication corridors are taxable properties and that such taxation is "mandated by statute."
